MAGNOL LOYALTY PROGRAM MEMBERSHIP AGREEMENT
This Magnol Loyalty Program Membership Agreement (“Agreement”) Tevfik Sok. Goba Sanat ve Tasarım Hizmetleri Ltd., operating at No:10/A Tepeören/Tuzla – Istanbul. Ltd. (“Magnol”) and the Magnol customer (“Member”) who has transferred his/her information to Magnol in order to register to the Magnol Loyalty Program (“Magnol”) described in this Agreement through Magnol Stores.
The subject of this Agreement is to determine the conditions of participation in Magnol, where the Member can participate by applying from Magnol member Magnol Stores within the borders of the Republic of Turkey and determined by Magnol, and the rights and obligations of the Parties accordingly.
- DEFINITIONS
Magnol Loyalty Program (“Magnol”) starts with the activation of the Member's Magnol membership by the relevant Magnol Store upon the Member shopping at one of the Magnol Stores included in Magnol and requesting and accepting to become a Magnol member, and the Member only It refers to the program created for users to spend the points they have earned within Magnol for their purchases from Magnol Stores.
Magnol also refers to the membership program that allows users to benefit from Magnol advantages and other campaigns at Magnol Stores determined by Magnol.
Magnol Stores refers to Magnol stores that are members of the Magnol Loyalty Program within the borders of the Republic of Turkey. Magnol Stores that are members of Magnol will be determined and changed unilaterally by Magnol.
Member refers to real person consumers with Magnol membership who meet the membership conditions written in this Agreement. Real Persons or Legal Entity Merchants and other natural or legal persons who cannot be described as "consumers" within the scope of the Law No. 6502 on the Protection of Consumers ("TKHK") cannot become Magnol members.
- TERMS AND CONDITIONS OF PARTICIPATION IN MAGNOL LOYALTY PROGRAM
2.1. Magnol Membership is realized upon the natural person customer informing the relevant Magnol Store personnel that he/she wishes to become a Magnol member, and upon the information sent to the Member via SMS and upon the Member's acceptance of this Agreement and other relevant documents forwarded to him/her. Membership activation date and time are as stated in Magnol's system. By becoming a member of Magnol, the Member will be deemed to have accepted this Agreement, Information Text and Explicit Consent Text.
2.2. The Member agrees to present the telephone number defined during membership and a valid identification document to the Magnol Store personnel upon request, while using the benefits (points) earned as a Magnol Member and as a result of the purchases made in Magnol Stores. However, the identity document will only be used for identity confirmation purposes and will not be processed in any way and will not be recorded in Magnol systems.
2.3. Magnol Program applications of persons under the age of 18 will only be valid with the approval of Magnol Stores, together with their parent or legal representative, stating that they have read, understood and accepted this Agreement, Information Text and Explicit Consent Text.
2.4. The Member's participation in Magnol is only valid if the Member fully and completely declares the information requested by the cashiers at Magnol Stores, accepts this Agreement, Information Text and Explicit Consent Text sent via SMS, and forwards the activation codes sent to his mobile phone to the officers. . Once the Member transmits the activation code sent to him/her to the officers, the Member will be deemed to have read and accepted the Agreement, Information Text and Explicit Consent Text.
The Member accepts, declares and undertakes that he will not forward the activation code to the officials without reading and accepting this Agreement, Information Text and Explicit Consent Text sent to him via SMS.
- GENERAL TERMS AND CONDITIONS
By becoming a member of Magnol, the Member declares that he/she accepts the following Magnol terms:
3.1. Within the scope of Magnol, the Member will be able to benefit from campaigns and promotions that can be carried out based on the shopping amounts he/she will make at Magnol Stores within the borders of the Republic of Turkey, using the phone number defined during membership, being entitled to a gift voucher, earning points that can be used as payment and discounts in subsequent purchases, etc., which will be exclusively determined and changed by Magnol. gains the right to benefit from various advantages.
3.2. The member can benefit from the advantages offered by Magnol only after the membership start dates.
3.3. The points accumulated in Magnol cannot be used for commercial purposes under any circumstances and are personal. The points can only be used for purchases made from Magnol Stores and cannot be requested to be paid to the Member in cash or any other form or transferred to a third party in any way.
3.4. Only real person consumers can benefit from Magnol membership and its advantages. If membership registration of persons who are not real person traders is made by mistake, then the Member's membership will be canceled as soon as it is detected and the refund of the advantages he/she has enjoyed until this date may be requested. In this context, the member accepts, declares and undertakes that he is a real person trader and that he will not make misleading statements in this regard.
3.5. If it is detected that they are being unfairly subscribed to Magnol or taking advantage of unfair advantages by taking advantage of the vulnerabilities of the system and using it for unfair gain in this regard, the memberships of the members are suspended without any warning or notification. In this case, the member cannot raise any objections or request compensation or other compensation. Magnol reserves the right not to share or change the criteria it has determined.
3.6. Within the scope of Magnol, the Member can earn points for purchases made from Magnol Stores, within the periods and conditions determined by Magnol. Magnol 1 point is equal to 1 Turkish lira. Points that the Member has not used for 24 months are automatically deleted.
3.7. Magnol reserves the right to make changes to Magnol terms of participation and Magnol terms of use at any time. The terms and conditions regarding the advantages and campaigns within the scope of Magnol will be determined by Magnol and may be changed at any time with the Member's approval and without any conditions and without any prior notice or notice to the Member. In case of changes to the Magnol Loyalty Program or discontinuation of the Magnol Loyalty Program, the Member cannot raise any objections or request compensation or other compensation.
3.8. The link containing a copy of the Information Text and Explicit Consent Text of this Agreement has been shared with the Member in the activation SMS, and it is the Member's responsibility to copy and keep the text of the Agreement in question.
3.9. Within the framework of the Magnol Loyalty Program, the principles regarding the processing of the Member's personal data are regulated in the Information Text and Explicit Consent text sent to the Member for activation purposes. It is assumed that the Member has read, understood and accepted these documents by sharing the activation code with the relevant Magnol Store personnel.
- OTHER PROVISIONS
4.1. This Agreement has been concluded for an indefinite period upon activation of membership. The Agreement shall be terminated if Magnol removes the Magnol Program or if the Member's membership is terminated by Magnol for justified reasons, or if the Member submits his/her request to terminate the Agreement to www.magnolistanbul.com, or if the Member gives information regarding the processing of personal data within the scope of the Loyalty Program. It will terminate automatically if he withdraws his express consent. Members must use their Magnol points before their membership expires. When the membership ends, the points accumulated on the card and the rights granted to the Member are deleted by Magnol.
4.2. Magnol accepts that the address specified in this Agreement and the Member accepts that the address notified by Magnol is their legal notification address. The Member agrees to inform Magnol within 7 days if there is a change in his address or the information provided within the scope of the Agreement.
4.3. This Agreement is subject to Turkish law. Istanbul (Çağlayan) Courts and Enforcement Offices are authorized to resolve disputes between the parties that may arise from this Agreement.
